NOTWITHSTANDING ANY OTHER PROVISION OF THESE TERMS, IN NO EVENT SHALL THE TOTAL LIABILITY OF PEQUOD'S PIZZA TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PEQUOD'S PIZZA IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE DATE ON WHICH THE CLAIM AROSE, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).
The limitations of liability set forth in this section shall apply regardless of the legal theory under which relief is sought, whether in contract, tort, negligence, strict liability, product liability, or otherwise, and even if Pequod's Pizza has been advised of the possibility of such damages.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.
9. Indemnification
You agree to defend, indemnify, and hold harmless Pequod's Pizza, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, licensors, service providers, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

13.1 Informal Resolution

13.2 Binding Arbitration
EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT, ALL DISPUTES ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL BE RESOLVED THROUGH BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) IN ACCORDANCE WITH ITS CONSUMER ARBITRATION RULES. THE ARBITRATION WILL BE CONDUCTED IN THE UNITED STATES, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF.
YOU UNDERSTAND THAT BY AGREEING TO ARBITRATION, YOU AND PEQUOD'S PIZZA ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT.
13.3 Class Action Waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY ARBITRATION OR OTHER LEGAL PROCEEDING SHALL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS, AND NOT AS A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. If this class action waiver is found to be unenforceable, the entire arbitration agreement shall be deemed null and void, and the dispute shall be resolved in court as provided in Section 12.
13.4 Small Claims Court
Notwithstanding the foregoing arbitration agreement, either party may bring an individual action in small claims court for disputes that qualify under the applicable jurisdictional rules of such court, provided that the action remains in such court and proceeds only on an individual, non-class, non-representative basis.
14. Term and Termination
